Conservatorships
When loved ones need help
Conservatorships
In California, conservatorship occurs when a court declares an individual unable to care for his or her legal matters and appoints another individual, known as the conservator, to do so. The conservator must then protect and provide for the adult in need of assistance by managing the individual and/or his or her estate.
General conservatorships can take three basic forms:
1. Conservatorship of the person
2. Conservatorship of the estate
3. Conservatorship of person and estate
Guidance Regarding Conservatorship Matters
The Law Offices of Indu Srivastav, APLC, provides guidance and representation in uncontested and contested conservatorship matters. Attorney Indu Srivastav, certified as a family law specialist by the California Board of Legal Specialization and experienced in the field of estate law, assists clients in matters involving:
Parents and elderly relatives: Conservatorship becomes necessary for individuals who may be unable to care for their estates, assets or property because of dementia, Alzheimer's or other health problems.
Developmentally disabled persons: Conservatorships can be completed by parents prior to a disabled individual's 18th birthday to ensure that his or her needs are met.
There are special procedures involved in establishing these arrangements, so it is important to speak with an attorney.
The Filing Of Initial Petitions In Court
Contested petitions: Petitions can be contested by the subject of a conservatorship or by family members, and litigation can ensue. The involvement of doctors and other experts is often essential in these cases.
Accountings: As a conservator, you are required to account periodically for the assets of an estate or a conservatee. Our firm educates clients regarding how to maintain these accountings, which must be handled properly.
