Common questions
Answers before you call
No. California was the first state to adopt no-fault divorce. A dissolution can be granted where the court finds irreconcilable differences leading to an irremediable breakdown of the marriage. If one spouse wants to end the marriage, they may do so regardless of whether the other agrees.
There is a statutory six-month waiting period that begins the day the responding spouse is served. The divorce is not automatically final at the end of it — custody, support and property issues often take longer. A motion for bifurcation can restore single status earlier in some cases.
At least one spouse must have lived in California for six months before filing, and in the county where the petition is filed for at least three months.
It is strongly advisable where there are children, a marriage over ten years, real estate or pension plans, or any question of spousal support. If your spouse hands you a settlement that looks equal, have it reviewed before you sign anything.
Gather information on separate and community assets and debts: copies of mail, bank and credit card statements, tax returns, insurance policies, pension and retirement records. Do not sign anything questionable, and speak to an attorney before moving out of the family residence.
